# Rights after death or incapacity: nominees

Plain-language help for ordinary people. General information, not legal advice. Helplines, portals and screen names were checked against official Government and regulator pages on 1 November 2026. ## What the law says

- Section 14 lets you nominate another person to use your DPDP rights if you die or become unable to act.
- Incapacity means unable to use your rights because of unsoundness of mind or infirmity of body (section 14(2)).
- Rule 14(4) says you can nominate one or more people, using the method and details each company asks for, under its terms of service.
- These rights start on 13 May 2027.

## How to nominate

1. Find the company's rights page or app settings.
2. Look for a nomination option, or send our [request letter](https://dpdpr.in/rights/rights-request-letter/) with the nomination box ticked.
3. Give the nominee's name, relation and contact.
4. Save the acknowledgement.
5. Tell your nominee where your list of accounts is kept.

## If you are a nominee

1. Write to the company and say you are the nominee.
2. Attach proof of the death or incapacity and your identity, as the company asks.
3. Ask for what the person could have asked: access, correction, erasure or a grievance fix.
4. Save the reference number. If there is no reply in the published time (at most 90 days), use the grievance route, then the Board.

## Not the same as a bank nominee

A nominee for a bank account, insurance policy or investment is set under those laws and decides who receives money. A DPDP nominee only uses data rights. Set both if you want both.
