# Section 39. Bar of jurisdiction

## In simple words

Civil courts cannot hear cases on matters the Board is empowered to decide, and no injunction can be granted against action under the Act.

- **What this means for you**: For matters under the Act, you go to the Board, not a civil court.

- **What this means for businesses**: Disputes on DPDP matters go to the Board and then the Appellate Tribunal.

- **Everyday example**: You cannot file a civil suit asking only for a DPDP penalty against a company.

No civil court shall have the jurisdiction to entertain any suit or proceeding in respect of any matter for which the Board is empowered under the provisions of this Act and no injunction shall be granted by any court or other authority in respect of any action taken or to be taken in pursuance of any power under the provisions of this Act.
